Celebrating 125 Years of Building Community

MAFELL is sustained by the people who use and love our tools. For the company’s 125th anniversary, we’re celebrating the people who work with our machines– the carpenters, woodworkers, and everything in between. The carpenter who invested the last of his savings in MAFELL machines. The two men refurbishing rundown shelters with cordless MAFELL tools, having carried them up the mountains on their backs. The carpenter using MAFELL machines to build a research station in the Antarctic. These are the stories that MAFELL is built on. These people and their stories have one thing in common: absolute confidence that the work they are undertaking could not be done better with any other tool.

MAFELL machines have a long life–they’re often passed down through generations of businesses and families. MAFELL’s story is also about the desire to develop products that are different and consistently better. Precision was and is a must for us–a manufacturer that sets itself to tasks and standards previously thought unachievable. It’s about the willingness to question conventions, to rethink, to pursue new pathways–even if they are long and sometimes indirect. “It’s in our DNA to rethink products,” says Thorsten Bühl, CEO of MAFELL AG since 2023.

The motto driving every development process is in Oberndorf machen–develop and build at headquarters in Oberndorf. Up to 85 percent of our parts are manufactured in-house. We have absolute confidence in our tools’ ability to perform just as reliably in the heat of Africa, on the seven seas, in the Antarctic cold and at high altitudes in the Alps as demonstrated in endurance testing at MAFELL in Oberndorf: 686 m above sea level; 48° 17’ N, 8° 34’ E. For almost a century, the expertise required to develop and build power tools has been handed down through the generations at MAFELL. This usually begins with an apprenticeship or a program of vocational education and practical learning. MAFELL is a family business in more ways than one.

OFFICIAL CONTEST RULES (the “Rules” or “Official Rules”)

1. SPONSOR AND CONTEST PERIOD:

The Mafell “125^th Anniversary” Contest (the “Contest”) is sponsored by Mafell AG, of Oberndorf, Germany (the “Sponsor”). The Contest begins at12:00:01 a.m. Eastern Time (“ET”) on October 1, 2024, and ends at 11:59:59 p.m. ET on December 31, 2024 (the “Contest Period”).

2. ELIGIBILITY:

The Contest is open to legal residents of Canada (excluding residents of the Province of Quebec) who have reached the age of majority in their province or territory of residence at the time of Contest entry; except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of the Sponsor, its parent companies, subsidiaries and affiliates, authorized Mafell dealers, its advertising/promotion agencies and any other individual(s), entity or entities involved in the development, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”). By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by the terms and conditions of these Rules.

3. HOW TO ENTER:

NO PURCHASE NECESSARY.

During the Contest Period, eligible individuals may enter the Contest by: (i) visiting the Contest website at: 125-years.mafell.com/ca (the “Contest Website”) (including, where applicable, by scanning the QR Code that is provided, in-store, at certain authorized Mafell dealers in Canada (excluding the Province of Quebec) or other links that are provided through other websites or advertising (including social media advertising) for the Contest by the Sponsor or its authorized dealers; (ii) completing the official Contest entry form (the “Entry Form”) with all required information (including your first and last name and valid email address, contact); (iii) uploading a photograph of yourself holding, or standing near, a Mafell tool that is clearly visible in the photograph; (iv) confirming your agreement that you have read and agree to be legally bound by these Official Rules; and (v) submitting your entry, following all entry instructions provided on the Contest Website. When all of the above-described entry steps are completed, you will receive one (1) entry in the Contest. Eligible individuals may, alternatively, obtain one (1) entry in the Contest by hand-printing a request for an entry, together with: (i) their full name, their complete mailing address (including postal code), email address, contact telephone number and age; and (ii) a sentence of not less than fifteen (15) words about their favourite kind of woodworking hand tool; on a plain piece of paper and mailing it in a sealed, postage-prepaid envelope to: Mafell Canada 125^th Anniversary Contest c/o Mafell AG, Beffendorfer Straße 4, 78727 Oberndorf a. N., Germany. There is a limit of one mail-in entry requests per person/email address. Each mail-in entry request must be: (a) mailed in a sealed envelope with sufficient postage to the above address; and (b) postmarked no later than the last day of the Contest Period, and received at the above address no later than January 16, 2025. Late, incomplete, illegible or otherwise non-compliant mail-in entry requests are ineligible. Each properly completed, eligible mail-in entry will result in one (1) Contest entry.

There is a limit of one (1) Contest entry per person/email address during the Contest Period, regardless of the method of entry.

If any person has attempted to: (i) enter more than once for the Contest; (ii) use multiple names, multiple identities or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in, or to disrupt, the Contest, then such person may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any incomplete, incorrect, late, garbled, illegible or incompatible information entered or provided by any entrant or purported entrant (all of which is void). The sole determinant of the time for the purposes of a Contest entry will be the official time-keeping device(s) or other relevant records of the Sponsor.

All entries and entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in, and receive a prize in, this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of an entry and/or other information for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeframe specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.

4. ONLINE ENTRY SUBMISSION REQUIREMENTS:

SUBMISSION REQUIREMENTS: By participating in the Contest, each entrant agrees to be bound by these Rules and by the interpretation of these Rules by the Sponsor, and further warrants and represents that all information and photographs, if applicable, contained in the entrant’s entry submission via the Contest Website or via mail-in entry (collectively, the entrant’s “Submission”):

is original to such entrant and that the entrant has all necessary rights in and to the Submission to enter the Contest (DO NOT use artificial intelligence (AI) tools to generate text, photos, images or other content in your submission);
does not violate any law, statute, ordinance or regulation;
does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
will not give rise to any claims of copyright, trade-mark or other intellectual property infringement, invasion of privacy or publicity, or otherwise infringe on any rights or interests of any third party, or give rise to any claims for payment whatsoever;
does not contain irrelevant material in response to the Contest;
is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, discuss or involve, without limitation, any of the following: nudity; drug consumption or smoking; sexual activity, or sexual innuendo; crude, vulgar or offensive language or behaviour; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones, depicts and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; conduct or other activities in violation of these Rules; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

LICENSE/USE OF ENTRIES: By entering the Contest and submitting an entry, each entrant: (i) grants to the Sponsor, in perpetuity, a world-wide, non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the entrant’s entry and Submission, in whole or in part, for advertising or promoting the Contest (including without limitation but for greater certainty, publication or display on the Contest Website during and after the Contest Period) or for any other reason; (ii) waives all moral rights in and to such entrant’s entry and Submission in favour of the Sponsor; and (iii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related cause of action. For greater certainty, the Sponsor or its promotional agency or designated content moderator (the “Reviewer”) reserves the right to screen all entries and Submissions and further reserves the right, in its sole and absolute discretion, to modify, edit or remove any entry or Submission, or to request an entrant to modify, edit or re-submit any entry or Submission, if: (i) a complaint is received with respect to the entry or Submission; (ii) the Sponsor determines, in its sole and absolute discretion, that the entry or Submission is not in full compliance with these Rules, or (iii) for any other reason in the sole and absolute discretion of the Sponsor. If any such action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying an entry and Submission (and therefore the associated entrant) – to help ensure that the Contest is being conducted in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.

5. THE PRIZE DRAW:

A random draw (the “Prize Draw”) will take place at [Oberndorf, Germany] at or about 3pm local time in Germany on January 17, 2025 to select one potential winner of each of the Prizes listed below, from among all eligible entries received in accordance with these Rules.

6. THE PRIZES AND ODDS OF WINNING:

There are two (2) prizes (each, a “Prize” and collectively, the “Prizes”) available to be won in the Contest, as follows:

One (1) grand prize, consisting of a one-time use only Mafell voucher, valid for the purchase, to a maximum value of CAD $12,500.00, of Mafell tools from an authorized Mafell dealer in Canada, at any time prior to 2:00 p.m. ET on December 31, 2025; and
One (1) secondary prize, consisting of a one-time use only Mafell voucher, valid for the purchase, to a maximum value of CAD $1,899.00, of Mafell tools from an authorized Mafell dealer in Canada, at any time prior to 2:00 p.m. ET on December 31, 2025.

Odds of Winning:

The odds of winning a Prize in the Contest depend on the number of eligible entries received in accordance with these Rules.

General Prize Conditions:

Each Prize may be used one time only, in a single purchase transaction, from an authorized Mafell tool dealer in Canada (excluding the Province of Quebec). The Prize voucher will be credited, at the time of purchase, and to the full extent applicable, to the purchase price (including applicable taxes) of any Mafell tool or tools sold by such dealer. In the event that the total purchase price (including applicable taxes) of the tool or tools purchased in the single purchase transaction in which the Prize is used exceeds the value of the Prize voucher, the full value of the Prize voucher will be credited in such transaction (the voucher will thereafter be void) and the winner will be solely responsible for paying any such excess. In the event that the total purchase price (including applicable taxes) of the tool or tools purchased in the single purchase transaction in which the Prize is used is less than the value of the Prize voucher, the Prize voucher will be credited in such transaction to the full value of the purchase transaction (including taxes) and any unused balance of the Prize voucher will be forfeited by the winner, and the voucher will thereafter be void.

Each Prize voucher expires, and will be of no further validity, effective as of 2:00 p.m. ET on December 31, 2025, if not already used, as aforesaid, in any qualifying purchase transaction before that time.

Each Prize must be accepted as awarded and is not transferable or assignable or (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions are permitted, except as Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize with an item or items of equal or greater approximate retail value.

If due to a printing, production, online, internet, computer or other error of any kind, more Prizes of a particular description are claimed or more Prize notifications are issued in error by the Sponsor than are as stated to be awarded according to these Rules, then, in addition to having the right to terminate the Contest immediately, the Sponsor reserves the right, in its sole and absolute discretion, to rescind invalid Prize claims and/or to hold a random draw after the end of the Contest Period from amongst all valid, eligible Prize claimants to award only the correct number of advertised Prizes in question. In no event and under no circumstances will the Sponsor be liable for more than the stated number and particular value of Prizes in these Rules.

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner understands and acknowledges that the winner may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should such winner’s Prize fail to be fit for its purpose or is in any way unsatisfactory, for any reason whatsoever. For greater certainty and the avoidance of any doubt, by accepting a Prize, a confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part, for any reason whatsoever.

7. WINNER CONFIRMATION PROCESS:

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS THE WINNER IN ACCORDANCE WITH THESE RULES, EVEN IF SUCH PERSON IS ANNOUNCED AS THE WINNER OR AN ELIGIBLE WINNER. BEFORE BEING DECLARED AS A CONFIRMED PRIZE WINNER, the potential Prize winner must: (a) first correctly answer, without mechanical or other aid and within forty-eight (48) hours of the question being presented to the entrant by the Sponsor or its representatives (which may be by way of email, telephone or otherwise, at the sole and absolute discretion of the Sponsor) the Sponsor’s required form of mathematical skill-testing question; and (b) sign and return to the Sponsor (or as it may in its sole and absolute discretion direct), within the time specified by the Sponsor, the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Released Parties from any and all liability in connection with this Contest, the entrant’s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of the entrant’s name, province/territory/city of residence, Submission, voice, statements about the Contest, and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever (including in or on the Contest Website, print, broadcast or the internet), worldwide and in perpetuity. If an eligible winner: (a) fails to correctly answer the skill-testing question within the required time; (b) fails to sign and return the properly-executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the applicable Prize as awarded for any reason; or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then such potential Prize winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize).

8. GENERAL CONDITIONS:

The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Released Parties will not be liable for: (i) the failure of any entry, Submission and/or other information to be received, captured or recorded for any reason whatsoever (including without limitation but for greater certainty, any failure of any app or website (including the Contest Website) during the Contest Period), any failure or delay of postal delivery services, any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website or filtering/operation of the functionality of Instagram, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer or mobile device related to or resulting from downloading any material connected to the Contest, all of which may affect a person’s ability to participate in the Contest); and/or (ii) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner.

The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual that it deems to be in violation of the Sponsor’s interpretation of the letter and spirit of these Rules. The Sponsor reserves the right to refuse participation by any person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter (all as determined by the Sponsor in its sole and absolute discretion). In its sole and absolute determination, the Sponsor may disqualify any person who acts in any manner to threaten or abuse or harass any person.

The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error(s), problem(s), tampering, unauthorized intervention, fraud or failure(s) of any kind whatsoever. Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

By participating in this Contest, each entrant or purported entrant: (i) agrees to be bound by these Rules; (ii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property–related cause of action; (iii) agrees to the publication, reproduction and/or other use of the entrant’s Submission on the Contest Website or in other media in connection with the Contest; and (iv) releases the Released Parties from any and all liability of any kind or nature whatsoever arising from, or in connection with, the Contest and such entrant’s or purported entrant’s participation, or attempted participation, in the Contest.

PRIVACY: By entering this Contest, each entrant expressly consents to the Sponsor and its agents and/or representatives who are involved in assisting the Sponsor with the Contest (the “Authorized Parties”) storing, sharing and using the personal information submitted by the entrant in connection with this Contest, for the purpose of administering the Contest and in accordance with Sponsor’s data protection policy at: https://www.mafell.de/en/data-protection-policy. This paragraph does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of that individual’s personal information. NOTE: Personal information of entrants may be stored on servers located in Germany, the U.S. or otherwise outside of Canada and therefore may be subject to the laws of Germany, the U.S. and/or other jurisdictions.

The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or time frames stipulated in these Rules, to the extent necessary deemed necessary by the Sponsor, for purposes of verifying compliance by any entrant, for purposes of verifying any other information relevant to the proper administration of the Contest, or as a result of any problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited, to point of sale, television, print or online advertising, any instructions or interpretations of these Rules given by an employee of the Sponsor or any of its dealer members; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to this Contest.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
